James McCulloch, a solicitor in our Disputes department, was recently asked to speak at the Eastern Landlords Association AGM. The firm has significant experience in dealing with landlord and tenant matters and James took this opportunity to outline the services which Cozens-Hardy is able to offer landlords:
Preparation of Assured Shorthold Tenancies
Ensuring that you have a well drafted assured shorthold tenancy is essential to making sure that both parties know exactly what the terms of the tenancy are. This is particularly the case when things go wrong and you need to rely upon the agreement. Not every landlord wants the same thing from a tenancy, which is why a bespoke assured shorthold tenancy drafted to your requirements will be more effective than a standard tenancy.
Preparation of Section 8 and Section 21 Notices
We are able to assist in the preparation and service of both Section 8 and Section 21 Notices. The courts are notoriously strict on ensuring that all of the statutory requirements of these notices have been validly followed.
Advice and assistance with possession proceedings
Possession proceedings can be complicated and daunting, especially for those that have not been to court before. Tenants are increasingly aware of their rights and the things that they can say to ensure that they prolong the possession process. We can assist in ensuring that possession is granted as swiftly and as painlessly as possible.
Assistance with deposit issues
Since the introduction of the new rules for tenant deposits, it is even more important to ensure that you have a clear inventory/schedule of condition at the start of a tenancy. However, even with this in place issues can still arise; we are able to advise landlords on how to combat these issues.
Recovery of rent arrears
The most common reason for people commencing possession proceedings is rent arrears. However, once possession has been obtained landlords often struggle to recover the outstanding arrears. We are able to help with the tracing of former tenants and recovery of any arrears owing from them.
Advice and assistance in relation to repairs
There can often be issues in relation to repairs with a tenancy. In serious cases, this can mean asking tenants to vacate and subsequently dealing with all the problems this can cause. We can offer help and advice on dealing with such a situation. We can also help if there is a dispute as to who should be carrying out the repairs.
